GoBeldi - Authentic Moroccan Traditional Clothing

1. Acceptance of Terms

By using the Platform, you agree to comply with these Terms. If you do not agree, you may not use the Platform.

2. Account Creation

Access to certain Platform features may require opening an account. You agree to provide accurate and complete information during registration and to update it if necessary. You are responsible for the confidentiality of your credentials and all activities performed through your account.

3. Platform Use

You agree to use the Platform in accordance with applicable laws and regulations. You may not:

use the Platform for illegal purposes;
disrupt or compromise its operation;
transmit viruses or harmful code;
infringe on others' intellectual property rights through the Platform.

4. Products and Orders

The Platform allows browsing and purchasing products offered by different sellers. GoBeldi does not guarantee the accuracy of product sheets or item availability. Any order is subject to seller acceptance.

5. Prices and Payments

Prices are set by sellers and may vary. Order payments must be made through the payment system integrated into the Platform. GoBeldi is not responsible for errors or problems related to payment processing.

GOBELDI guarantees the proper technical execution of payments through its authorized provider.

6. Shipping and Delivery

Sellers are responsible for product shipping. GoBeldi does not guarantee delivery times and disclaims any responsibility in case of delay or transport problems.

Delivery is ensured by GoBELDI's partner carriers under the seller's responsibility.

7. Returns and Refunds

Returns and refunds are subject to each seller's own policies. GoBeldi is not responsible for their management. For any request, you must contact the seller directly.

This does not deprive the customer of rights provided by Moroccan consumer legislation, particularly regarding legal warranty.

8. Intellectual Property

All Platform content (texts, images, logos, etc.) is the property of GoBeldi or its licensors, protected by intellectual property laws. You may not use, reproduce or distribute it without prior written authorization.

9. Limitation of Liability

GoBeldi cannot be held responsible for direct, indirect, incidental or consequential damages resulting from your use of the Platform or purchased products. This includes loss of profits, data or intangible benefits, except in case of gross negligence or intentional fault by GoBELDI.

10. Indemnification

You agree to indemnify and hold GoBeldi harmless from any claims, damages or costs arising from your use of the Platform or violation of these Terms.

11. Personal Data

11.1

GOBELDI collects, uses and stores personal data of its customers, such as name, email address, phone number and postal address, in accordance with its privacy policy, the General Data Protection Regulation (GDPR) and Moroccan law No. 09-08 relating to the protection of individuals with regard to the processing of personal data.

11.2

This data is collected for the exclusive purpose of ensuring order management, payment, product delivery, customer relations and transaction security on the Platform.

11.3

The customer expressly consents to the collection, use and storage of their personal data by GoBELDI for these purposes.

11.4

In accordance with law 09-08, the customer has at any time the right to access, rectify, delete and object to the processing of their personal data. They can exercise these rights by sending a request to the following address: info@gobeldi.com.

11.5

GoBELDI undertakes to protect its customers' personal data and not to communicate it to unauthorized third parties, except for legal obligation or express customer agreement.

11.6

The processing of GoBELDI customers' personal data is declared and subject to the control of the CNDP (National Commission for the Control of Personal Data Protection), in accordance with the provisions of law 09-08.

12. Applicable Law - Competent Jurisdiction

These Terms are governed by the laws of the Kingdom of Morocco. Any dispute falls under the jurisdiction of the Commercial Court of Casablanca.

13. Terms Modification

GoBeldi reserves the right to modify these Terms at any time. Changes will be published on the Platform and will take effect after a 7-day period from their publication. Continued use of the Platform constitutes acceptance of the new Terms.

14. Force Majeure

GoBELDI, as well as partner sellers, cannot be held responsible for any failure or delay in the execution of their obligations if these result from a case of force majeure as defined by Moroccan law and jurisprudence.

The following are considered cases of force majeure, without this list being limiting: natural disasters, pandemics, total or partial strikes, wars, social unrest, power cuts, interruptions of telecommunications or Internet networks, government decisions or any other circumstance reasonably beyond GoBELDI's control.

In case of occurrence of a force majeure event, the affected obligations will be suspended for the entire duration of the event, without the customer being able to claim compensation.

If the duration of the force majeure event exceeds thirty (30) days, either party may terminate this contract without compensation.

15. Customer Service

GoBELDI provides users with a customer service accessible by email at info@gobeldi.com as well as by chatbot and telephone assistance.

Any request received (complaint, question, feedback) will be processed within a maximum of forty-eight (48) working hours from its receipt.

This service aims to provide rapid and professional assistance to Platform customers.

16. Contract Language

These Terms and Conditions are written in French.

In case of translation into another language, only the French version will be authoritative and will prevail over any other version in case of interpretation divergence.
